  1. ACKNOWLEDGEMENT OF THE GENERAL TERMS AND CONDITIONS OF SALE AND SUBSCRIPTION.

1.1 – Only customers who are of legal age may subscribe to the website. Subscription is totally free of charge. The subscription credentials (e-mail address and password) are to be used exclusively by the Customer and may not be disclosed to third parties. The Customer agrees to keep them secret, to ensure that no third party has access to them and to immediately inform EXIT Music if there is any suspicion or knowledge of any misuse or improper disclosure of them. Each Customer is allowed to subscribe to www.exitmusic.it only once. Should EXIT Music discover that the same Customer has made several subscriptions on the site, EXIT Music reserves the right to proceed, immediately and without prior notice, to block the respective second account.
1.2 – The Customer guarantees that the personal information provided during the subscription procedure is complete and true. The use of false, and/or invented, and/or fictitious names is strictly forbidden. The Customer agrees to hold EXIT Music blameless and relieved of all damages, obligations for compensation and/or penalties arising from and/or in any way connected with the violation by the user of the rules on subscription to the website or on the storage of subscription credentials.
1.3 – The contract between EXIT Music and the Customer is to be considered concluded with the confirmation of the order, even if only partial, by EXIT Music. This confirmation is to be considered implicit, unless otherwise communicated in any way to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept these GTC.
1.4 – If the Customer is a consumer (i.e. a person purchasing the products for purposes not related to their profession), once the online purchase procedure has been completed, the Customer must print or save an electronic copy and in any case retain these GTC, in accordance with Articles 50 et seq. of Legislative Decree 206/05.
1.5 – Any right of the Customer to damage compensation or reimbursement is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and/or property caused by the non-confirmation, even partial, of an order.
1.6 – The catalogue of products with their prices, discounts, special offers and availability is only for purchase on the e-commerce www.exitmusic.it and is not intended for the retail shop.
1.7 – By accepting the GTC, the Customer authorises EXIT Music to send newsletters to the address given during subscription. The Customer may unsubscribe at any time, either by using the link provided in all newsletters, or by sending a communication to info@exitmusic.it.

  1. PURCHASE MODALITIES.

2.1 – The Customer may only purchase the products available in the online catalogue of the www.exitmusic.it website at the time the order is placed, as described in their respective description sheets. The picture attached to the descriptive sheet of a product may not be exactly representing its characteristics but may differ in colour, size, accessory products in the picture. All purchase support information (glossary, product sheets, etc.) is intended as mere generic information material, not referring to the real characteristics of a single product. For the article specific composition or technical data sheets, please consult the websites of the direct manufacturers or distributors.
2.2 – Customers are not required to pay a minimum amount for their order.
2.3 – Under normal order processing conditions, EXIT Music processes orders received within 24 working hours. Order processing means delivery to the courier. Order processing may be delayed for various reasons (technical or otherwise). EXIT Music cannot be held responsible for any delay in the processing of the order or in the delivery of what has been ordered.

2.4 – To change an order, the Customer must write to info@exitmusic.it indicating the order number and what type of change is wanted. Variations cannot be guaranteed, as orders are processed immediately and automatically.
2.5 – In the event of unusual orders from any Customer (for example, with regard to the quantity of the products purchased, or the frequency of purchases, or the placing of orders without concluding them with the respective payment), EXIT Music reserves the right to take all necessary actions to put an end to the irregular order, including suspending access to the website, cancelling the subscription to the website, not accepting or cancelling the existing irregular orders.
2.6 – EXIT Music also reserves the right to refuse and cancel orders that come from a Customer who has given false, incomplete or otherwise inaccurate identification data, and/or from a Customer with whom EXIT Music has an ongoing legal dispute, or from a Customer who has previously violated these EXIT Music GTC on access to the website, i.e. by cancelling the subscription at its own discretion.
2.7 – Correct processing of the order is confirmed by EXIT Music by a reply to the e-mail address given by the Customer. This confirmation message will indicate the Date and Time of processing of the order and an “Order Number”, to be used in any further communication with EXIT Music. The message will include all the data provided by the Customer, who will verify that they are correct and promptly communicate if any correction is needed.
2.8 – In the event of non-confirmation of the order, EXIT Music guarantees prompt notification to the Customer.
2.9 – Customers requiring international shipping can ask for an estimate on shipping costs by providing the following data to customer service: Recipient’s exact and complete address, article code(s) and respective quantities. Estimates sent to Customers are free of charge without any obligation.

  1. TERMS OF PAYMENT – INVOICING.

3.1 – When purchasing products by credit card, the credit card shall be debited at the time the order is created.

3.2 – When purchasing products using PayPal payment methods, the Customer’s PayPal account shall be debited at the time the order is created.
3.3 – EXIT Music reserves the right to ask the Customer for additional information (e.g. landline phone number) or to send copies of documents proving the ownership of the Card used. In the absence of the requested documentation, EXIT Music reserves the right not to process the order.
3.4 – At no time during the purchase process is EXIT Music able to know information about the Customer’s credit card or PayPal account, which are sent via secure connection directly to the site of the bank handling the transaction.

  1. SHIPPING: DELIVERY COSTS – TIME – MODALITIES.

4.1 – EXIT Music does not charge shipping costs for orders over 100€.
4.2 – Table for shipping thresholds and costs: For orders up to €99.99, €5.90 shipping cost is charged, except for the smaller islands and the Lagoon of Venice.
4.3 – Under normal order processing conditions, when the order is placed by 11:00 a.m. on working days, delivery is carried out within 24 working hours; if the order is not placed within the aforementioned parameters, delivery is carried out within 48 working hours. Delivery may be delayed for various reasons (technical or otherwise). EXIT Music cannot be held responsible for any delay in the processing of the order or in the delivery of what has been ordered. Shipment begins when the courier has taken your order and sent it to the company branch to be handled for delivery. Delivery by the courier is made for places which are normally reached within a maximum of 24/48 working hours from collection (unless there are problems with delivery such as the recipient not being there, etc.), while for Islands or places which are not reached within 24/48 working hours, couriers normally take an additional 24/48 working hours.

4.4 – EXIT Music ships orders within Italy, San Marino, Vatican City. EXIT Music carries out International shipments.
4.5 – EXIT Music ships orders using local and national couriers for Italy, such as BRT, GLS, SDA. The courier is assigned automatically; therefore, it is not possible to indicate a specific courier on the shopping cart page.
4.6 – It is not possible to specify a preferred delivery time to the courier. The delivery time is determined by the courier according to its requirements.
4.7 – By accepting these GTC, the Customer consents to the disclosure of their telephone number to the courier for notifications relating to their shipment. This consent is necessary and mandatory for the conclusion of the online purchase contract. Delivery of what has been ordered is made on ground floor.

4.8 – From the moment the order is taken over by the courier, EXIT Music cannot be held responsible for delayed delivery, nor for the condition of the ordered products.

4.9 When the courier delivers the products, the Customer is bound to check:

  • that the number of packages delivered corresponds to the number indicated on the delivery note;
  • that all packaging is intact, not broken, not wet or in any way damaged, including the sealing materials (adhesive tape or strapping);
  • any damage to the packaging and/or the product, or the mismatch in the number of packages or indications, must be immediately notified, by affixing “SUBJECT TO CHECK” on the courier’s proof of delivery (SPECIFYING THE REASON FOR THE SUBJECT, e.g. “damaged packaging”, “crushed packaging”, “missing package”, etc.). Once the courier’s document has been signed, the Customer may not raise any objection regarding the external characteristics of what has been delivered;
  • if any product is not received, is not intact or corresponding to the order, any problems must be notified within 3 days from delivery using the www.exitmusic.it site on the contact page.

4.10 – If the first attempt by the courier is unsuccessful, the courier will leave a notice of unsuccessful delivery and will try again the next day (excluding Saturdays and public holidays). If the second attempt is also unsuccessful, the courier notifies EXIT Music, which together with the customer will arrange a new delivery.

4.11 In the event of non-delivery/collection of the products in stock at the courier’s warehouses within 5 working days due to the repeated non-delivery to the specified address and the unavailability of the Customer, the ordered products will be returned to EXIT Music’s warehouses. Any new request by the Customer for a new shipment will be processed with a price surcharge due to extra costs.

  1. RIGHT OF WITHDRAWAL.

5.1 – In compliance with Articles 64 et seq. of Legislative Decree 206/05, if the Customer is a consumer (see point 1.4), the Customer has the right to withdraw from the purchase contract for any reason whatsoever, without the need to provide explanations and without any penalty.

5.2 – In order to exercise this right, the Consumer-Customer, within 14 calendar days from the date of delivery of the products, must contact EXIT Music Customer Service by the following e-mail: info@exitmusic.it stating that they wish to exercise the right of withdrawal. The Customer shall indicate in the e-mail which order number is being referred to and the complete list of the products to be returned, reporting the product code and quantity; name and surname, bank and IBAN code where the refund is to be made.

5.3 – The right of withdrawal is subject to the following conditions:

  • The Customer must wait for the reply to the withdrawal request from the EXIT Music Customer Service;
  • The shipping costs for the return of the products shall be paid by the Customer in compliance with Legislative Decree No. 185 of 22 May 1995;
  • The right applies to the whole product purchased; it is not possible to exercise withdrawal only on part of the product purchased;
  • The right does not apply to custom-made or clearly customised products;
  • The purchased product must be intact and returned in its original packaging, complete in all its parts. The affixing of labels or adhesive tapes directly on the original product packaging must be avoided in all cases;
  • The package must be sent to: EXIT Music s.n.c., Via Tapparelli 43 12038 SAVIGLIANO (CN)
  • Until the proof of delivery to our warehouse, the shipment is under the full responsibility of the Customer;
  • When the product is delivered to the warehouse, it will be examined to assess any damage or tampering not resulting from transport. If the package and/or the original packaging are damaged, EXIT Music will deduct a percentage from the refund to cover the repair costs.

5.4 – The right of withdrawal expires totally, if the product is not intact (packaging and/or its contents) and if EXIT Music determines:

  • the non-diligent use of the product that has compromised its condition, or the use of any consumable materials;
  • the absence of the original outer packaging and/or inner packaging
  • the absence of integral elements of the product (accessories, manuals, parts, …);
  • damage to the product due to causes other than its transport;
  • in the event of the expiration of the right of withdrawal, the products will remain at EXIT Music, available for collection by the Customer.

5.5 The refund to the Customer is made by bank transfer or Paypal without any additional costs. Within 15 days from the return of the products, EXIT Music will proceed to refund the amount after checking the condition of the products.

  1. WARRANTIES.

All products sold by EXIT Music are covered by the standard producer’s warranty. In order to benefit from warranty service, the Customer must keep the invoice.

6.1 – The warranty applies to the product showing a conformity defect, as long as the product itself is used correctly, in compliance with its intended use and according to the attached technical documentation. This warranty is intended only for private consumers (natural persons who purchase the products for purposes that are not related to their profession, i.e. they make the purchase without indicating a VAT number on the order form). In the event of a conformity defect, EXIT Music will restore the conformity of the product through repair/replacement or reduction of the price, at no cost to the Customer, until the contract ends.

6.2 – In the event that, for any reason, EXIT Music is unable to return a product under warranty (repaired or replaced) to its customer, EXIT Music may proceed at its own discretion to refund the amount paid, taking into account the use of the product, or replace it with a product of equal or better features.

6.3 – The time it takes to repair or replace the product depends exclusively on the producer’s policies and EXIT Music cannot be held responsible for any delay in repair or replacement.

6.4 – In cases where the warranty includes the return of the product, the product must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, accessories, etc.); to limit damage to the original packaging, we recommend inserting it in a second box; in all cases, the affixing of labels or adhesive tapes directly onto the original product packaging must be avoided. The Customer will be provided with authorisation to return the product by e-mail.

  1. PRIVACY.

7.1 – The personal data requested when placing an order are stored and processed in order to satisfy the requests expressed by the Customer. EXIT Music guarantees the respect of the regulations on the processing of personal data, regulated by the Privacy Code with reference to EU Regulation no. 697/16 and Legislative Decree no. 196 of 30.06.03. 7.3 – The sales contract between the Customer and EXIT Music is stipulated in Italy and regulated by Italian Law. For the solution of civil and criminal disputes arising from the stipulation of this remote sales contract, if the Customer is a consumer, the local jurisdiction is that of the court of reference of the Customer’s town of residence; in all other cases, the local jurisdiction is exclusively that of the Court of Saluzzo.
